For at-once orders from our available to sale stock, we are able to ship within 5 business days.
For all seasonal shipments, we require a minimum lead time of 60-days (i.e. 60 days from the time the order is placed until the day it is shipped.)
All pre-booked orders must meet a minimum of $1,000.00.
Products or goods purchased from LivinLifeMan shall only be sold at the manufacturer’s suggested retail price (MSRP) In the event the Retailer chooses to place the products or goods for sale at a discount, the Retailer shall not discount the products more than 20% below MSRP.
Permission for special sale events beyond the 20% discount by the Retailer must be requested in writing to LivinLifeMan and will typically be granted on a semi-annual basis
No products or goods purchased from or produced by LivinLifeMan shall be resold by or through any on-line auction or online store (such as eBay, Amazon or other similar sites) without the express, written authority of LivinLifeMan. If Retailer is planning to sell products produced by LivinLifeMan in an online marketplace/store, it must be owned by the Retailer and listed on the Wholesale Application to be approved by LivinLifeMan. Retailer must use images and descriptions created and supplied by LivinLifeMan.
LivinLifeMan will make available images that you might require for your print and online presence Should you require any additional images, please contact us. Any imagery you provide yourself must be approved prior to use.
RESELLING TO RETAILERS
Any Retailer who distributes LivinLifeMan goods and products to any entity for re-sale must require their Retailer or Retailer to strictly adhere to these same Retailer and Retailer guidelines as set forth in this Wholesale Agreement. Any Retailer who does not enforce these guidelines with their own re-sale Retailers or Retailers will be subject to termination of this agreement.
Payment terms extended by LivinLifeMan are as follows: 50% of the order total is due upon shipment of the product to the Retailer. No product will be shipped until payment is received Net 30 terms will be provided for the remaining 50% of the balance due. Credit Card information will be obtained at the time the order is placed and the Retailer will be notified before the credit card is charged.
In the event that the Credit Card used to secure the order expires, is cancelled or is otherwise no longer valid, the Retailer agrees to contact LivinLifeMan with updated payment information.
Should terms be extended, accounts will be subject to an interest charge of 2% of the amount of the entire invoice beginning 30 days after the invoice is due and increasing by 2% every 15 days thereafter. Terms will be reverted to pre-payment if account is overdue more than twice in a fiscal year. LivinLifeMan retains the right to terminate any delivery or suspend further deliveries in the event the Retailer’s financial condition becomes unsatisfactory. All shipping charges will be added to the invoice for each PO.
All products come unpackaged and may require additional folding and package prior to resale.
Retailer will be responsible for all Merchandise shipping and handling expenses, including (if applicable), customs clearance, import/export fees, freight risks and insurance, and Retailer may be required to act as the importer of record for international shipments. Retailer must notify LivinLifeMan of any claimed shipping error or damage within 5 days of receipt of Merchandise. Retailer’s failure to give such notice within that five-day period shall be deemed a waiver of Retailer’s claim for incorrect or damaged shipments.
LivinLifeMan cannot be responsible for shortages when shipments are directed to a third party. It is the responsibility of Retailer to inspect upon receipt, that all merchandise delivered matches its order.
Within 10 days of Customer’s receipt of Merchandise, Customer may return (i) Merchandise that does not conform to LivinLifeMan’s product specifications or (ii), Merchandise damaged or shipped incorrectly if notice of condition is given within 5 days of receiving the merchandise. Returns will be credited to Retailer’s account or replaced at LivinLifeMan’s discretion.
In the event of a product shortage, LivinLifeMan will give the Retailer the option to either have the missing product shipped to them at-once or to have the amount of the product credited to their account. Please contact firstname.lastname@example.org regarding shortages.
MERCHANTABILITY AND MISREPRESENTATIONS
Retailer agrees that LivinLifeMan makes no warranty, express or implied, as to the merchantability of LivinLifeMan products. Retailer also agrees that LivinLifeMan is not liable for any misuse or misrepresentations of the goods by the Retailer.
EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, LIVINLIFEMAN MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE MERCHANDISE. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED BY LIVINLIFEMAN. IN NO EVENT SHALL LIVINLIFEMAN BE LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST REVENUES OR PROFITS OF CUSTOMER.
